1. Purpose and Scope
(1) This Acceptable Use Policy ("AUP") supplements our General Terms and Conditions (GTC) and sets out, on a binding basis, which uses of our platform www.every.health, of the products offered via the platform, and of the medical services, diagnostic laboratory services and supply of medicinal products arranged via the platform are not permitted.
(2) This AUP applies to all users of our platform, regardless of whether you only use the platform, have created a user account, place an order, or make use of a recurring service.
(3) In the event of any conflict between this AUP and our GTC, the GTC shall prevail. In addition, the respective policies of our payment service providers apply, in particular the Acceptable Use Policy of PayPal, as amended from time to time.
2. General Rules of Conduct
When using the platform, you undertake in particular:
(a) to act exclusively in your own name and to provide accurate, complete and up-to-date information;
(b) to create only a single user account per person;
(c) to treat your access credentials as confidential and not to make them available to any third party;
(d) not to take any actions that impair the security, integrity or availability of the platform, including automated access (scraping, bots), circumvention of security measures, reverse engineering, or attempts to exploit security vulnerabilities;
(e) not to post or transmit any content that is unlawful, offensive, discriminatory, misleading, harmful or capable of adversely affecting other users, the service providers involved, or us in terms of safety, rights or reputation.
3. Prohibited Uses of Medical Services and the Supply of Medicinal Products
The following uses are expressly prohibited:
(1) Untrue or incomplete medical information. In the context of medical history (anamnesis), medical consultation, treatment, prescription or diagnostic examination, only complete and truthful information may be provided. Concealing or misrepresenting pre-existing conditions, allergies, medications taken, pregnancy, age or other medically relevant circumstances is prohibited and endangers your own health.
(2) Orders in another person's name or on behalf of others. You may not order or obtain any medical services, tests or medicinal products in the name of another person or for any person other than yourself.
(3) Identity deception. The use of false identity information, third-party identity documents, or the concealment of your age — in particular by minors — is prohibited. The use of our medical offers requires a minimum age of 18 years.
(4) Resale, transfer or commercial use. Medicinal products, home test kits or other health products obtained via the platform may not be resold, transferred, given away, exchanged or used for commercial purposes. Medicinal products are intended exclusively for the personal use of the ordering person.
(5) Misuse of recurring services. Recurring supplies, subscriptions or prevention programmes may not be used to obtain medicinal products or tests in a quantity that exceeds personal, medically indicated need or that enables stockpiling, storage or onward distribution.
(6) Influencing medical decisions. Attempts to obtain a particular medical treatment decision, prescription or diagnosis that is not medically indicated or that violates applicable law are prohibited.
(7) Emergencies. The platform is not suitable for medical emergencies. In the case of life-threatening or acute conditions, please immediately contact the emergency services (emergency number 112 in Germany) or a local emergency care facility.
4. Products and Services Not Offered Via the Platform
The following are expressly not offered via our platform and may therefore not be requested or ordered:
(a) narcotics within the meaning of the German Narcotics Act (Betäubungsmittelgesetz, BtMG);
(b) anabolic steroids, hormone preparations for doping, bodybuilding or lifestyle purposes outside recognised medical indications;
(c) medicinal products for the termination of pregnancy;
(d) medicinal products and products the acquisition of which is prohibited or requires authorisation in your country of residence, where the required authorisation is not in place;
(e) counterfeit, expired or unauthorised medicinal products;
(f) any products and services that are not expressly part of our current offer on the platform.
5. Prohibited Payment and Business Practices
The following are prohibited in particular:
(a) using means of payment to which you are not entitled, including stolen, fraudulently obtained or third-party credit cards, debit cards or bank cards, as well as third-party accounts;
(b) knowingly providing incorrect billing or delivery addresses in order to circumvent delivery restrictions, tax obligations or legal provisions;
(c) wrongfully initiating chargebacks, in particular after delivery or performance of the service has taken place;
(d) using or attempting to use our platform for money laundering, terrorist financing, tax evasion, fraud or other financial crimes;
(e) using our platform from countries or regions that are subject to applicable sanctions of the European Union, the United Nations or a comparable sanctions regime, where such use is unlawful;
(f) using our platform for activities that are prohibited under the Acceptable Use Policy of PayPal or any other payment service provider used by us, as amended from time to time.
6. Prohibited Content and Communication
In the context of communication via our platform — for example, in messages to partner physicians, in customer support communications, or in user-generated content — the following are prohibited in particular:
(a) transmitting unlawful, violent, extremist, pornographic, child-endangering or youth-endangering content;
(b) transmitting content that infringes the rights of third parties, in particular copyright, trademark, personality or data protection rights;
(c) harassing, threatening or insulting other users, partner physicians, employees of partner pharmacies, partner laboratories or our employees;
(d) transmitting malware, viruses or other harmful code.
7. Consequences of Violations
(1) In the event of violations of this AUP, we may — depending on the severity and taking into account the circumstances of the individual case — in particular:
(a) temporarily restrict or block your access to the platform;
(b) refuse, suspend or terminate individual orders or recurring services;
(c) terminate your user account;
(d) notify the competent authorities, law enforcement bodies, supervisory authorities or payment service providers involved, to the extent legally required or permitted;
(e) assert claims for damages and take other legal action.
(2) Remuneration claims already arising, statutory retention obligations and statutory notification obligations remain unaffected.
(3) In the case of particularly serious violations, in particular identity deception, fraud, fraudulent use of means of payment or endangerment of other users, we reserve the right to block access immediately without prior hearing.

9. Changes to This Acceptable Use Policy
(1) We may amend this AUP, in particular to take account of changes in the legal framework, new products or services, new risks, or new requirements of our payment service providers.
(2) The current version is available on the platform at this URL. We will notify registered users of significant changes in an appropriate manner.
